Control in the community: A qualitative analysis of the experience of persons on conditional discharge in Hong Kong

This is the first study on the service user perspective of the conditional discharge (CD) regime under section 42B of the Mental Health Ordinance, which is Hong Kong’s form of mandatory outpatient treatment (like the community treatment order (CTO) in the UK).

Compulsory mental health admission and treatment, where individuals may be detained and/or administered treatment despite their refusal, stands as a striking exception to the cardinal rule that patients with mental capacity have a right to refuse treatment. How compulsory powers such as these can be justified (if at all), and how such regimes should be regulated so that the rights of individuals subjected to such regimes (both under local legislation and international human rights instruments such as the UN Convention on the Rights of Persons with Disabilities) can be properly protected, are key issues that CMEL’s research examines.  More information is available on the personal profile pages of our Prof Daisy Cheung, Prof Eric C. In addition to the mental health of individuals, CMEL’s research also considers the law and ethics of mental health at the macro level, focusing on the promotion of mental health in populations. For further information, click here.
