Mapping the legal foundations of planetary mental health

This article provides a conceptualisation of ‘planetary mental health law’ and why it matters. It is argued that, while a ‘planetary mental health law’ can be said to already exist, albeit in preliminary form, it is in great need of being developed into a clearer and more coherent regime. Prior to proposing fundamental changes to the international system, soft law should be resorted to as a complement to existing international obligations, and states need to bolster their level of national commitment to defend the right to mental health on a healthier planet.

Public mental health takes on a macro perspective to mental health, focusing on the promotion of mental health in populations. It recognises that mental health is not only a concern at the level of an individual, but that the prevention of mental and substance misuse disorders can and should take place at the population level. CMEL’s research in this area considers this important issue in several key contexts, including: (i) COVID-19 and the risks to public mental health brought about by ill-planned and poorly executed lockdowns and (ii) the significance of mental health in the global health security agenda.
